نگرانی از شکنجه و بدرفتاری با زندانیان عقیدتی ایران
جعفر عظیم زاده رئیس هیئت مدیره اتحادیه آزاد کارگران ایران سعید یوزی عضو کمیته پیگیری برای ایجاد تشکلهای آزاد کارگری کاوه مظفری روزنامه نگار و دانشجو غلامرضا خانی کارگر شرکت واحد اتوبوسرانی تهران و حومه مهدی فراهانی شاندیز معلم بازنشسته چهار فعال اتحادیه ای و روزنامه نگار مذکور از زمان بازداشتشان به جرم قصد شرکت در همایش مسالمت آمیز ویژه اول مه روز جهانی کارگردر معرض شکنجه و بدرفتاری هستند. آنها زندانیان عقیدتی هستند و فورا باید بدون قید و شرط آزاد شوند. جعفر عظیم زاده وسعید یوزی هنوز به دادگاه برده نشده اند. کاوه مظفری، غلامرضا خانی و مهدی فراهانی شاندیز برایشان وثیقه هایی تعیین گشته است که خانواده هایشان از تهیه آنها عاجزند در حالیکه معلوم نیست به چه جرمی متهم هستند. هر پنج نفر به دنبال دستگیریشان در مراسم اول مه، در پارک لاله واقع در مرکز تهران تا کنون در زندان اوین بسر می برند. گزارشها حاکیست که کاوه مظفری به عنوان یک روزنامه نگار در حال پوشش خبری دادن به تظاهرات روز جهانی کارگر بوده است. و هیچیک از آنان به نظر نمی رسد که ملاقات با وکلایشان داشته اند.

بیش از 200 نفر از فعالین واقعی کارگری به همراه خانواده هایشان در پارک لاله واقع در مرکز تهران گرد آمده بودند تا در یک گرد همائی آرام به مناسبت اول مه روز جهانی کارگر شرکت کنند. به کمیته سازمانده اول مه 2009 اجازه گردهمائی داده نشد و وقتی که شرکت کنندگان شروع به تجمع کردند به شدت توسط نیروهای امنیتی متفرق شدند، به طوری که گفته می شود با استفاده از گاز اشک آور و باتون برای پراکندن یا دستگیری شرکت کنندگان به آنها حمله برده اند. طبق گزارش، از گروهای کوچک کارگری برای پیوستن به تجمع اصلی ممانعت شده و سپس با مشت و لگد مورد ضرب و شتم واقع شده اند. بر اساس کنفدراسیون سراسری اتحادیه های کارگری (ITUC) بیش از 200 نفر در جریان واقعه بازداشت شده اند که بعدا حدود 150 نفر از آنان به زندان اوین انتقال یافته اند. در روزها و هفته های بعد اکثر این افراد از زندان آزاد شده اند.
اطلاعات پیشینه
مطابق قانون کار ایران، کارگران کارخانه هایی که دارای بیش از 50 نفر کارگر هستند مجازند تا شورای اسلامی کار را ایجاد کنند. هدف شوراهای اسلامی تحت قانون مصوب 2001 اساسا تبلیغ و گسترش فرهنگ اسلامی و دفاع از دست آوردهای انقلاب اسلامی است، مانند؛ برگزاری نماز جمعه؛ از بر کردن و توجه به شعارهای اسلامی؛ برگزاری مراسمات موعظه، سخنرانیها و خطابه های مذهبی به مناسبتهای مختلف؛ و تلاش برای غنی سازی اوقات فراغت کارگران و خانواده هایشان. کسانی اجازه کسب موقعیتهای ریاست بر شوراهای اسلامی را به دست می آورند که توسط یک هیئت رسمی انتخاباتی تأید شده باشند. در حالیکه تشکیل اتحادیه های کارگری مستقل در ایران ممنوع است و کسانی که تلاش می کنند چنین تشکلهائی را ایجاد کنند با خطر تعقیب و زندان مواجه هستند. آگاهی در حال رشد از حقوق کارگران منتج به ایجاد تعدادی از اتحادیه های مستقل و سازمانهای حمایتی کارگران شده است. گرچه بعضی پذیرفته شده اند اما اعضاء تشکلهای دیگر با زندان و دیگر اعمال سرکوب مواجه اند.
درخواست: - از مسئولین دولت ایران می خواهیم فوری و بی قید و شرط چهار فعال کارگری و کاوه مظفری که به جرم شرکت در همایش مسالمت آمیز ویژه روز جهانی کارگر بازداشت شده اند را آزاد کنند. چرا که آنان به جرم عقیده و باور زندانی هستند و تنها به جرم خواست بهره مندی از حق آزادی بیان، تجمع و همبستگی در پیوند با حمایتشان از حقوق و تشکلهای کارگری بازداشت شده اند.
- مقامات را ملزم می دانیم اطمینان دهند که کارگران بازداشت شده شکنجه و یا مورد بدرفتاری واقع نشده اند؛
- از مقامات می خواهیم اطمینان دهند که فعالین واقعی اتحادیه ای را بیشتر از این به خاطر اقدام به حرکتهای مسالمت آمیزانه و طبق حقوق به طور جهانی به رسمیت شناخته شده شان برای ایجاد و وصل شدن به اتحادیه های کارگری بازداشت نشوند و اجازه تجمعات آرام به فعالین واقعی کارگران داده شود.

Up to 2000 workers’ rights activists and trade unionists, along with their families had gathered in Laleh Park, central Tehran, on 1 May to take part in a peaceful rally marking International Workers’ Day. The 2009 May Day Organizing Committee’ were denied permission to hold the rally and after participants started to gather, they were forcibly dispersed by security forces, which are said to have used tear-gas and baton charges in the course of their attempts to disperse or arrest participants. Smaller groups of workers, were reportedly isolated from the main gathering then kicked, punched and beaten. The International Trade Union Confederation (ITUC) has stated that over 200 people were arrested at the event, of which around 150 were subsequently taken to Evin Prison. Most of these people were released in the following days and weeks.
BACKGROUND INFORMATION Under Iranian labour legislation, workers are allowed to form Islamic Labour Councils (ILCs) in companies with more than 50 workers. The ILCs’ objectives, under 2001 legislation, are mainly to “propagate and spread Islamic culture, and defend the achievements of the Islamic Revolution”; “set up Friday prayers; recite and pay tribute to religious slogans”; “establish meetings for sermons, religious discourse and lectures, on various occasions”; and “endeavour to enrich the times of rest for the workers and their families”. Those permitted to stand for leadership positions in the ILCs are vetted and approved by an official selection body. Although the formation of independent trade union bodies remains prohibited in Iran and those who attempt to form such bodies risk detention and prosecution, a growing awareness of workers’ rights has resulted in the creation of a number of independent unions and workers’ support organizations. While some have been tolerated, members of others have faced arrest and other acts of repression.
RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in Persian, English or your own language: - calling on the authorities to immediately and unconditionally release the four trade union activist and Kaveh Mozafffari, for having taken part in peaceful events marking International Workers’ Day, as they are prisoners of conscience, detained solely for the peaceful exercise of their right to freedom of expression, assembly and association in connection with their support of workers’ rights and trade unions; - urging the authorities to ensure that workers detained on May Day are not tortured or otherwise ill-treated; - calling on the authorities to ensure that trade union rights activists no longer face arrest for peacefully exercising their internationally recognized right to form and join trade unions and that peaceful gatherings of workers’ rights activists are permitted to take place. They are believed to be prisoners of conscience who should be released immediately and unconditionally if held solely for peacefully exercising their rights to freedom of expression, assembly and association. جعفر عظیم زاده و دیگر کارگران زندانی را آزاد کنید روز جهانی کارگر امسال، یازدهم اردیبهشت بیش از یکصد و پنجاه تن در پارک لاله تهران با ضرب و شتم و خشونت بسیار دستگیر شدند. این دستگیری ها در حالی ست که هر ساله در تمام دنیا کارگران در این روز به خیابان می آیند و صدای اعتراض خود را به نابرابری و تبعیض فریاد می زنند. اما دوستان و همکاران ما هنوز با گذشت 44 روز، بدون هیچ دلیل قانونی در زندان نگه داشته شده و حتی از حقوق زندانیان محروم بوده و مورد بدرفتاری و فشارهای جسمی و روحی قرار گرفته اند.از تعداد بیش از 150 تن از دستگیر شدگان هنوز 6 نفر در بازداشت به سر می برند. جمله جعفر عظیم زاده رئیس هیئت مدیره اتحادیه آزاد کارگران ایران، از روز شنبه 16 خرداد تاکنون به بند 240 منتقل شده و اجازه ملاقات و حتی تماس تلفنی با خانواده اش را ندارد. شواهد فوق حاکی از اعمال فشارهای جسمی و روحی بر ایشان می باشد. هم چنان که به کرات از ابتدای بازداشت مورد ضرب وشتم و بدرفتاری قرار گرفته اند. اتحادیه آزاد کارگران ایران این نوع برخورد با کارگران و رهبران کارگری را در راستای سرکوب مطالبات برحق انسانی و پایمال نمودن پایه ای ترین حقوق کارگران ایران ارزیابی میکند و ادامه بازداشت آنان را عملی غیر قانونی و غیر موجه دانسته و اعلام می نماید در صورت آزاد نشدن فوری و بی قیدو شرط جفعر عظیم زاده و سایر کارگران دربند، برگزاری تجمعات اعتراضی را حق مسلم خود می داند.
